Acceptable Use

AI Chatbot

Automated Responses. The Chatbot is an automated tool and is not a human representative. All quotes, project scopes, and agreements are only valid when confirmed in writing by an authorized Altissa representative.
Your Data. We do not sell, rent, or share your Chatbot conversations or personal information with third parties for AI training, advertising, or any other commercial purpose. Conversations may be reviewed internally solely to improve our Services, respond to your inquiries, and ensure quality and security.
Do Not Share Sensitive Information. Please do not submit passwords, financial information, health information, or other sensitive personal data through the Chatbot. Altissa is not responsible for sensitive information voluntarily disclosed by users in Chatbot conversations.
Prohibited Use. You agree not to abuse or misuse the Chatbot, including but not limited to:
- Attempting to manipulate, "jailbreak," or bypass the Chatbot's intended functionality or safety measures;
- Submitting spam, excessive, or automated requests;
- Using the Chatbot to transmit unlawful, abusive, harassing, or offensive content;
- Attempting to extract underlying prompts, code, or proprietary system information;
- Using the Chatbot for any purpose unrelated to legitimate inquiries about our Services.
Enforcement. We reserve the right to monitor Chatbot interactions and, at our sole discretion, to restrict, suspend, or permanently block access (including by IP address ban) for any user who abuses or misuses the Chatbot, without prior notice. Where applicable, we may report unlawful activity to the appropriate authorities.
Availability. The Chatbot is provided on an "as is" and "as available" basis. We may modify, suspend, or discontinue the Chatbot at any time without notice.

Client Responsibilities & Content
Clients engaging our Services agree to:
- Provide accurate, complete, and timely information, content, and materials required for the project;
- Respond to requests for feedback, approvals, and revisions within a reasonable timeframe;
- Designate an authorized point of contact for project decisions.
You represent and warrant that all content, materials, images, text, logos, and trademarks you provide to us are owned by you or properly licensed for use, and that such materials do not infringe upon the intellectual property rights of any third party, violate any applicable law, or contain defamatory, obscene, or unlawful material. Altissa is not responsible for verifying the ownership, accuracy, or legality of client-supplied content.
Delays caused by client unresponsiveness, incomplete materials, or scope changes may result in adjusted timelines and additional fees. Projects inactive for more than thirty (30) days due to client inaction may be placed on hold or closed at our discretion, and deposits may be forfeited as outlined in the applicable service agreement.

Payments, Deposits & Refunds
Fees for Services are outlined in individual proposals, quotes, or service agreements. We also offer a free mockup for your project. Unless otherwise stated in writing:
- A deposit is required before work begins and is non-refundable once work has commenced;
- Final deliverables will not be released until full payment is received;
- Overdue invoices may be subject to interest charges and suspension of Services, including hosting and maintenance;
- Recurring services such as hosting and maintenance are billed in advance and are non-refundable once the billing period has begun;
- A 48-month contract is applied to all monthly payment pricing plans.
All prices are in Canadian dollars (CAD) unless otherwise specified and are subject to applicable taxes, including HST.

Project Scope & Revisions
The scope of each project, including the number of included revisions, is defined in the applicable proposal or service agreement.
Requests falling outside the agreed scope ("scope creep") may require a change order and additional fees. We reserve the right to decline requests that materially alter the nature of the original engagement.

Hosting & Maintenance Services
Where we provide hosting or maintenance Services:
- We do not guarantee uninterrupted or error-free uptime, as hosting relies on third-party infrastructure providers;
- We will make commercially reasonable efforts to maintain backups, but clients are encouraged to retain their own copies of critical content;
- Hosting and maintenance plans renew automatically unless cancelled with written notice in accordance with the applicable service agreement;
- Upon termination of hosting Services, we will provide reasonable assistance with migration, which may be subject to additional fees.

Copyright & Intellectual Property
All content on this Website, including text, graphics, logos, design elements, code, and images, is the property of Altissa or its licensors and is protected by Canadian and international copyright, trademark, and intellectual property laws.
Upon full payment for project-based Services, ownership of the final deliverables (such as completed website files and custom designs) will be transferred to the client, unless otherwise specified in a signed agreement. We reserve the right to retain ownership of proprietary tools, frameworks, and reusable code components developed by Altissa.
We also reserve the right to display completed work in our portfolio and marketing materials unless a client requests otherwise in writing.
If you believe that any content on our Website infringes upon your copyright, please contact us at info@altissa.ca with a detailed description of the alleged infringement, and we will investigate and respond promptly.

Limitation of Liability
To the fullest extent permitted by applicable law, Altissa, its directors, employees, and contractors shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of your access to, use of, or inability to use the Website or Services.
This includes, but is not limited to, damages for loss of profits, data, business interruption, or any other commercial or intangible losses, even if we have been advised of the possibility of such damages.
In jurisdictions that do not allow the exclusion or limitation of certain liabilities, our liability shall be limited to the maximum extent permitted by law. In no event shall our total liability to you for all claims exceed the amount you paid to us for the specific Service giving rise to the claim.
We are not responsible for third-party services, plugins, hosting providers, or software integrated into your project, nor for downtime, security breaches, or technical issues originating from such third parties.

- Your infringement of any third-party rights, including intellectual property or privacy rights.

Termination

However, we understand that times can be tough; if you fail to pay for monthly hosting, maintenance, or other recurring monthly services, we provide a free one-month protection grace period before shutting down or suspending your services. Either party may terminate a Services engagement in accordance with the applicable service agreement.
Upon termination:
- Fees for work completed to date remain due and payable;
- Deposits are non-refundable;
- Provisions relating to intellectual property, limitation of liability, and indemnification shall survive termination.

Force Majeure
Altissa shall not be liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, internet or utility outages, third-party service failures, labour disputes, pandemics, or government actions.

General Provisions
Entire Agreement. These Terms constitute the entire agreement between you and Altissa regarding your use of the Website and supersede any prior agreements. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
Governing Law. These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Ottawa, Ontario.
No Waiver. Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.
Assignment. You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
Changes to These Terms. We reserve the right to update or modify these Terms at any time without prior notice. Continued use of the Website or Services following any changes constitutes your acceptance of the revised Terms.
